Definition Of A Bedroom in New York State
What Makes A Room A Bedroom?

The explanation below is derived from a variety of reliable sources, however, it is not a professional legal opinion. For a professional definition of what constitutes a bedroom, you should consult with an architect, an engineer, or your local building department.

In New York State, a legal bedroom (technically a sleeping room) must be a "habitable room designed for sleeping". The determination of whether a room can be considered a bedroom is defined by specific health safety, fire safety, habitability, & building code standards.

To legally qualify as a bedroom, a room must conform to the specific standards listed below. While these specifications may vary slightly from municipality to municipality (town, village or county), most jurisdictions follow similar core requirements. Locally, these standards are outlined in Article XXIV Sec. 873.2421 of the Westchester County Sanitary Code.

Size:
Every bedroom occupied by one person must contain at least 70 sq ft of floor space (80 sq ft in NYC), and every bedroom occupied by more than one person should contain at least 50 sq ft of floor space for each occupant. In addition, a bedroom must have at least 7' of distance from wall-to-wall in one direction (may be 8' in NYC).

Ceiling Height:
The room must have a clear ceiling height of at least 7'. If the ceiling is sloped, at least one-third of the room must have a 7' ceiling clearance.

Egress & Ventilation:
The room must have two legally recognized exits (usually a door and a window that can be easily opened from inside). The egress window must open (without obstruction) to the outdoors, a yard, or a street. The egress window must also meet minimum size requirements (typically at least 12 sq ft) with an openable area of at least 24" high by 20" wide and a maximum 44" window sill height from the floor.

Access:
The room must not serve as the only hallway or means of access to another bedroom or main living space. The room must be separated from other living areas by standard walls and a door. It cannot be a hallway, an open alcove or a pass-through room.

Heating:
The room must be able to maintain at least 68°F in winter via a permanent heat source (plug-in heaters are not considered permanent heat sources).

Closets:
A closet is NOT legally required for a room to be defined as a bedroom. According to the International Residential Code (IRC), the definition for a “bedroom” is based on safety and habitability standards … not storage. While a closet is a typical expectation & convenience, the absence of a closet would not disqualify a room from being considered a bedroom.

RED FLAGS
(Conditions that may indicate a room doesn’t meet legal bedroom standards)

  • Small windows that don’t fully open or ones positioned too high from the floor often indicate non-compliant spaces.
  • Low ceilings (below 7 feet) are particularly common in basement conversions or attic spaces that haven’t been properly modified.
  • Rooms without dedicated heat sources or climate control systems (ventilation) may not meet habitability standards.
  • Spaces that require passing through another room for access would violate most building codes.

NOTE: Converted basements or garages often present multiple compliance challenges because of issues with ceiling height, egress, moisture control, and proper ventilation.
